Conflict
Resolution
If
you have planned well and hired a good contractor you should be able to
solve any problems that may arise. Having a good working relationship
and communicating in a positive, straightforward way should make any unexpected
problem easy to resolve. Unfortunately, there are circumstances where
you cannot agree and a settlement must be reached. There are three options
for resolution:
· Mediation - no judge is involved. A mediator helps negotiate a mutually
acceptable solution. This is the least time-consuming process and only
final when both sides agree.
· Binding Arbitration - no judge is involved. An architect or construction
expert reviews the case with the two parties and/or their lawyers and
makes a decision that is final--appeal is not an option.
· Lawsuits - Both parties hire lawyers and the case goes to court where
a judge's decision is binding. This is the most lengthy and expensive
option. The process also becomes public record and should be considered
as a last resort.
